I have always wondered why nine men (or women) in black should trump the people. If all the courts were indeed impartial and objective, they could work, but that is far from the truth. It seems that partisanship and ideologies have more influence upon judicial decisions than the constitution and the law.
When we start talking about liberal and conservative judges, we are implying their decisions will be influenced by their ideologies. In fact, this seems to be the case. Court watchers can predict the vote split on most cases with uncanny accuracy by the nature of the case. If what has become a political body instead of a judicial body is going to make FINAL decisions which amount to LEGISLATION, we should be thinking of allowing the House of Representatives to have the last word with a super-majority vote. If it's legislation, it's the peoples' business.
A democracy can survive only if people of good will outnumber and out perform those who attempt to circumvent the constitution and laws to advance an agenda whether good or bad. Without strict adherence to the constitution, politicians and the courts will make there own rules. A failure to stop legislative courts will condemn us to the whims of rascals and devils.
